Privacy Policy & Information Practices Notice

Action Financial Planning, LLC (“AFP,” “we,” “us”) is committed to protecting the privacy of our clients’ nonpublic personal information. This notice describes how we collect, use, share, and safeguard information, consistent with Regulation S‑P and applicable Idaho law.
We collect nonpublic personal information about you that helps us provide financial planning and advisory services, including: (i) information you provide on intake forms, agreements, and through our client portal (e.g., name, address, email, phone, Social Security number, date of birth, household details); (ii) financial information and documents you upload or authorize us to access (e.g., account balances, holdings, transactions, income, tax returns); and (iii) information from third‑party service providers you choose to use with us (e.g., RightCapital, AdvicePay, custodians, or other vendors).
We use your information to deliver planning and advisory services, communicate with you, process payments, maintain records, and comply with legal and regulatory obligations.
We do not sell client information. We share nonpublic personal information only as permitted by law, such as with: (a) service providers who support our operations (e.g., secure client portal, payment processing via AdvicePay, archiving technology vendors, IT/security vendors); (b) your professional advisors (e.g., CPA, attorney, insurance agent) with your authorization; (c) your authorized representative or a person holding your power of attorney; (d) regulators or law enforcement when legally required; and (e) in connection with a proposed or actual sale, merger, or transfer of all or a portion of our business.
Because we do not share your information with nonaffiliated third parties for their marketing, no opt‑out is required. If you wish to restrict sharing with your other professional advisors, please notify us in writing. In addition, if we ever change our practices in a way that would require offering you the ability to opt out of information sharing, we will notify you and provide an opportunity to opt out before sharing your information.
We maintain administrative, technical, and physical safeguards designed to protect your information, including access controls, encryption in transit where supported, and vendor due diligence. Access to information is limited to personnel and providers who need it to serve you. Arrangements with companies or independent contractors not affiliated with AFP that receive client information are subject to confidentiality agreements. We continue to protect the nonpublic personal information of our former clients in the same manner as that of current clients for as long as we retain it.
We retain advisory books and records in line with federal and state investment‑adviser requirements. Unless a longer period is required by law or contract, we keep client and firm records for not less than five (5) years from the end of the fiscal year in which the last entry was made or the advisory relationship ended, whichever is later. For the first two (2) years, such records are maintained in an easily accessible place (generally our primary office or secure cloud system).
Examples include: client agreements, communications and recommendations, financial plans and deliverables, billing and invoices, advertising/marketing materials (kept at least five years from last use), written acknowledgments (e.g., ADV and privacy policy receipts), and compliance records. Core organizational records (e.g., formation documents, ownership records, and policies and procedures) are maintained for the life of the firm and no less than five years after dissolution.
We may retain information longer where necessary to comply with legal holds, tax or audit requirements, or to protect against potential disputes. When records are no longer required to be kept, we securely dispose of or anonymize them.
